ADU Permits and Approvals in Malibu
Permitting an ADU in Malibu means satisfying state ADU law and the city's Local Coastal Program at the same time, with septic, geology and fire reviewers weighing in along the way. We prepare the application and stay with it until the permit is issued.
Who Issues ADU Permits in Malibu
Inside city limits, ADU applications go to the City of Malibu Community Development Department. The department was formed when the City Council merged Planning and Environmental Sustainability on November 25, 2024, and it now holds Planning, Building Safety and the Environmental Health staff who review septic capacity. Other reviewers, including the Los Angeles County Fire Department and the city's geotechnical and public works staff, comment on the same file.
Topanga and other unincorporated canyon areas outside the city line are a different case. There, ADU permits come from Los Angeles County, with planning review and building plan check handled by county departments under the county's own coastal and zoning rules. Part of our early work is confirming which agency has jurisdiction, which matters for parcels high in Las Flores Canyon near the city boundary.

Malibu's ADU Rules and the Coastal Program
Malibu's ADU standards sit in Municipal Code Chapter 17.44 and in Section 3.6(N)(1) of the Local Coastal Program's Local Implementation Plan, which uses the older term second units. On June 22, 2026 the City Council adopted Ordinance No. 535, Zoning Text Amendment 25-003, updating those regulations. Ordinances that amend the coastal program can also need state certification, so we confirm which provisions are in effect when we file.
The order of review is distinctive. As quoted in the state housing department's November 2024 findings letter, Malibu's ordinance says every ADU application is analyzed for LCP and Coastal Act compliance before it is reviewed under the ADU chapter. In practice that means habitat buffers, bluff and beach setbacks, public access and visual resources are settled first. A plan that ignores them tends to stall at intake.
State Timelines That Apply to a Malibu ADU Application
California requires ministerial review of ADUs and JADUs, without a hearing or discretionary approval. Since January 1, 2026, the city must tell you within 15 business days whether your application is complete, listing anything missing in writing. For a lot that already holds a house, a complete file then starts a 60-day window in which Malibu must say yes or no, and a no has to come with written comments explaining how to fix each deficiency.
A denial is not the end of the road either. The law requires an appeal route, and an appeal must be decided in writing inside 60 business days. Older documents and some city handouts still cite Government Code 65852.2 and 65852.22; those sections were renumbered by SB 477 into Government Code 66310 through 66342, and we cite the current sections in correspondence. The real time sink in Malibu is usually before the clock starts, while surveys, reports and septic findings are assembled.

Septic, Geology and Fire Reviews in a Malibu ADU Permit
Environmental Health reviews the plans to confirm the existing onsite wastewater system can handle the added flow from the ADU. If it cannot, the project needs a septic upgrade with its own design, testing and approval. We pull septic records and, when they are thin, arrange an inspection before design so this review does not surprise anyone late in the process.
Hillside, bluff and canyon sites usually need a geotechnical report reviewed by the city's geology staff, and beachfront parcels may need coastal engineering analysis. The Los Angeles County Fire Department reviews access, water supply and fuel modification, and sprinklers where they are required. Each reviewer can issue corrections, and we respond to every round until the file clears.
From ADU Permit Issuance to Final Sign-Off
Once the building permit is issued, inspections follow the construction sequence: foundation, framing, rough plumbing, electrical and mechanical, insulation, and final. Septic work has its own inspections. If the project includes grading or drainage improvements, those are inspected too. We schedule inspections and meet inspectors on site so questions are answered on the spot.
At final, the unit receives its sign-off and can be occupied. Keeping the permit history complete matters later, when you rent, refinance or sell, because buyers and lenders look for a clean record that matches the built unit.

FAQs
ADU Permit Questions in Malibu
What is the timeline for a Malibu ADU permit?
Two state clocks apply. Within 15 business days of submittal the city owes you a written completeness answer, and for a property with an existing house it then has 60 days to act on the complete file. Assembling that file, with surveys, septic findings and any geology or coastal reports, often takes longer than the review itself.
Do I need a coastal development permit for an ADU in Malibu?
Some form of coastal approval is part of every Malibu ADU, since the coastal program check comes ahead of the ADU chapter. What that approval looks like depends on the project and the site, and we identify the right path when we prepare your application.
Can the city deny my ADU application?
It can deny an application that does not meet the rules, but a denial must come with a written list of the deficiencies and how to correct them. The law also requires an appeal process.
Who permits ADUs in Topanga?
Topanga is unincorporated, so ADU permits come from Los Angeles County rather than the City of Malibu. County coastal and zoning rules apply there.
What permit fees should I expect for a Malibu ADU?
Fees depend on the size and scope of the project. A unit with 750 sq ft or less of interior living space is exempt from impact fees under state law, and above that size the fee must scale with the main house's square footage. Plan check and permit fees still apply.
